These terms and conditions (“Terms”) govern your use of everstrives.com and any purchases you make from Everstrives, operated by Sportura LLC, 1007 Orange St, Wilmington, DE 19801, USA (“Everstrives”, “we”, “us”). By placing an order, you agree to these Terms.
1. Our products. We sell compression socks designed for everyday comfort, activity and recovery. Product images are for illustration, and minor variations in color or appearance may occur depending on your screen and production batch.
2. Sizing. Compression socks work best when they fit correctly. Please use the size guide on our website before ordering. If you are unsure about your size, contact us at info@everstrives.com and we will help you choose.
3. Health information. Our socks are not a medical device and are not intended to diagnose, treat, cure or prevent any medical condition. Information on our website is general and not medical advice. If you are pregnant, have circulation problems, diabetes, skin conditions or any other medical condition, consult your doctor before using compression products. Stop using the socks if you experience pain, numbness, discomfort or skin irritation.
4. Orders. An order is an offer to purchase. The contract is concluded when we send you an order confirmation. We reserve the right to reject or cancel an order, for example in the event of suspected fraud, pricing errors or stock problems; in such cases, any amount paid will be refunded.
5. Prices and currency. Prices are displayed in the currency of your chosen market and include applicable taxes and duties (DDP). Shipping costs are shown at checkout before you complete your purchase. We reserve the right to change prices at any time, but changes will not affect already confirmed orders.
6. Payment. We accept the payment methods displayed at checkout, including card payments and “Buy Now, Pay Later” solutions such as Klarna. “Buy Now, Pay Later” is a payment solution for a single, one-time purchase provided by a third party and governed by their terms and conditions. We do not offer subscriptions or recurring payments (see our Subscription Policy).
7. Shipping, returns and cancellations. Delivery, returns, cancellations and refunds are governed by our Shipping Policy, Return Policy, Cancellation Policy and Refund Policy, which form part of these Terms. All orders are covered by our 60-day money-back guarantee as described in our Return Policy.
8. Defects and product quality. If your socks have a manufacturing defect, such as faulty seams or material failure under normal use, contact us at info@everstrives.com with your order number and photos, and we will offer a replacement or refund. Normal wear and tear, damage from incorrect washing or drying, snags, and misuse are not covered. Please follow the care instructions on the packaging to keep the compression effective for as long as possible.
9. Consumer rights. Nothing in these Terms limits your mandatory statutory rights as a consumer, including rights under the EU Consumer Rights Directive, UK consumer law and applicable US law.
10. Intellectual property. All content on everstrives.com, including images, text and logos, is owned by or licensed to Everstrives and may not be used without our permission.
11. Limitation of liability. To the extent permitted by law, our total liability for an order is limited to the amount you paid for that order. Nothing in these Terms excludes any liability that cannot be excluded by law.
12. Governing law. These Terms are governed by the laws of the State of Delaware, USA, without limiting the mandatory consumer protection rights you have under the laws of your country of residence.
